1. Introduction
This Privacy Policy explains how Fyby Inc. (“Fyby,” “we,” “us,” or “our”) collects, uses, discloses, and otherwise processes your information when you use our websites (fyby.ai, fyby.app), applications, APIs, our AI agent, Fyby Atlas, and other related services (collectively, the “Services”).
It is your responsibility to read this Privacy Policy carefully. By creating an account or using our Services, you agree to the collection, use, and sharing of your information as described in this Privacy Policy. If you do not agree with our policies and practices, you must not use our Services.
We reserve the right to update this Privacy Policy at any time and at our sole discretion. When we make changes, we will revise the date at the top of the policy. Your continued use of the Services after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.
2. Information We Collect
We collect information to provide, maintain, and improve our Services, and to advance our business interests.
2.1 Information You Provide Directly
Account Information: When you create an account, we collect information such as your name, email address, and password. If you subscribe to a paid service, we and our third-party payment processors collect payment and billing information.
User Content (Inputs): We collect the data you provide when you use our Services. This includes the prompts, questions, text, documents, images, audio, or other files you submit to our AI agent, Fyby Atlas (“Inputs”). If you include personal information in your Inputs, this information may be reproduced in the Output. Please do not provide any sensitive, confidential, or personal information in your Inputs that you are not authorized to share or that you do not want us to process, use, and retain.
Communication Information: If you contact us for any reason, we will collect your name, contact information, and the contents of your messages. We use this information to respond to your inquiries and for our own business purposes, including training and quality assurance.
2.2 Information We Collect Automatically (Usage Data)
When you access or use our Services, we automatically collect a wide range of diagnostic, technical, and usage-related information (“Usage Data”). This includes your IP address, browser type, operating system, device information, the features you use, the actions you take, access dates and times, and referring website addresses. All Usage Data is and will be owned solely and exclusively by Fyby. To the extent any ownership rights in or to the Usage Data vest in you, you hereby assign to us all rights, title, and interest in and to the same. We may use Usage Data for any lawful purpose.
2.3 Information for AI Model Development
Our AI models, including Fyby Atlas, are trained on data from licensed third-party sources, publicly available information, and data from human reviewers. For our free or consumer-focused Services, we use User Content (Inputs and Outputs) to train, develop, and improve our models and Services. We consider this a critical business interest.
Logged-in Users: If you are logged into your account, you may have the right to opt-out of having your User Content used for model training, as detailed in Section 6. Please note that opting out may result in a degraded or limited service experience.
Non-Logged-in Users: If you use our Services without logging into an account, you grant us full rights to use any data you provide to or obtain from our Services for product development and model training purposes.
3. How and Why We Use Your Information
We use the information we collect for the following business and commercial purposes, as permitted by law:
To Provide, Maintain, and Improve our Services: To operate our Services, process Inputs, deliver Outputs, authenticate users, process payments, and provide support. We also use Usage Data to analyze performance, fix bugs, and improve the functionality and commercial viability of our Services.
To Develop New Products and for Research: We use information, including User Content and Usage Data, to conduct research, develop and train our AI models, and create new features and technologies that advance our business.
For Safety, Security, and Fraud Prevention: To protect the rights, property, and safety of Fyby, our users, and the public. This includes monitoring for, investigating, and preventing activities that may violate our policies or be illegal. We reserve the right to review your content for such purposes at our sole discretion.
To Communicate With You: To send you service-related, technical, and administrative messages. Subject to your preferences and applicable law, we will also send you marketing communications. You may not opt-out of essential service-related communications.
To Comply with Legal Obligations: To comply with applicable laws, regulations, legal processes, or governmental requests, and to use or share your information if we believe, in our sole discretion, it is necessary to protect our rights and interests.
4. How We Share Your Information
We may share your information with third parties in the following circumstances:
Vendors and Service Providers: With third-party vendors who perform services on our behalf, such as hosting, payment processing, and analytics. These parties are contractually restricted from using your information for any other purpose.
Business Transfers: If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, your information may be sold or transferred as part of that transaction. You consent to such transfers and agree that the successor entity may continue to use your information as set forth in this policy.
Legal Requirements: We may disclose your information to third parties if we believe in our sole discretion that disclosure is necessary to (a) comply with any applicable law or governmental request; (b) enforce our Terms and Conditions; (c) protect the security or integrity of our Services; or (d) protect the rights, property, or safety of Fyby, our users, or the public. Aggregated or De-identified Information: We may share aggregated or de-identified information, which can no longer reasonably be used to identify you, for any business purpose without restriction.
5. Data Security and Retention
5.1 Security Measures
We implement commercially reasonable security measures to protect your information. However, no internet transmission is ever fully secure, and
we cannot and do not guarantee absolute security. You acknowledge that you provide your personal information at your own risk. You are solely responsible for securing your account credentials.
5.2 Data Retention
We retain your personal data for as long as necessary for our legitimate business interests, including to fulfill the purposes for which we collected it, satisfy legal or reporting requirements, resolve disputes, and enforce our agreements. Deleted conversations or accounts will be removed from our active systems, but may be queued for deletion from our back-end systems for up to 30 days, and may remain in our backup archives for a longer period as determined by our internal policies.
6. Your Privacy Rights and Choices
6.1 Exercising Your Rights
Depending on your location, you may have statutory rights with respect to your personal data, including rights of access, correction, and deletion. You can exercise some of these rights through your account settings. For all other requests, you may contact us at

A Note on Correction: Due to the technical complexity of our AI models, if an Output contains factually inaccurate personal information relating to you, it may not be feasible for us to correct the inaccuracy. While you may submit a correction request, we cannot guarantee we will be able to correct such information within the model’s outputs.
6.2 Your Rights Regarding AI
Right to Opt-Out of Model Training: If you are logged into your account, you have the right to direct us not to use your User Content to train or improve Fyby Atlas. You can exercise this right through your account settings.
Rights Regarding Automated Decision-Making Technology (ADMT): In line with emerging regulations in California, we provide you with rights related to our use of ADMT, including rights to be informed and to opt-out of certain uses.

7.1 Information for California Residents (CPRA)
You have rights under the CPRA to know, delete, correct, opt-out of sale/sharing, and limit the use of your Sensitive Personal Information (SPI). You can exercise these rights via the links on our website footer or by contacting us. The table below summarizes our data practices.
